SECOND BEER BAR AND RESTAURANT,

O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on February 9, 2009, pursuant to Notice of Proposal (“NOP”) number 16866 dated November 26, 2008, to suspend liquor licence number 200988 issued to 21st Sun Enterprises Inc. (The) operating as SECOND BEER BAR AND RESTAURANT, 2346 Dufferin Street, Toronto, Ontario, M6E 3S4;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and Yanbin Chen, an officer of the corporate licensee, were present and participated in the pre-hearing;
AND WHEREAS the Licensee was reminded of Rule 6.1 of AGCO Revised Rules of Practice, that should it decide to retain a licensed or unlicensed representative, the representative must complete a Declaration of Representative (Form 1) and deliver a copy to all parties and file it with the Manager of Hearings within three days;
AND WHEREAS the Licensee was reminded of Rule 5.5 of AGCO Revised Rules of Practice, that should it require language interpretation in a language other than French or American Sign Language, it is to be provided by and at the cost of the Licensee;
AND WHEREAS this NOP matter is scheduled for a hearing commencing March 27, 2009;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, if any, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 10.2, ten (10) days before the hearing date.
