O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario ("AGCO") held a pre-hearing teleconference on February 13, 2009, pursuant to Notice of Proposal ("NOP") number 16853 dated November 21, 2008, to suspend liquor licence number 813075 issued to Pizza Mom Pizza Inc., (the "Licensee"), operating as PIZZA MOM PIZZA, 631 Kennedy Road, Scarborough, Ontario, M1K 2B2;
AND WHEREAS the Registrar's Representative, Joyce Taylor, and the Licensee's Representative, Richard Elbirt, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing March 19, 2009;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar's Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness' evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar's Representative will complete any further disclosure pursuant to Rule 10 and the Registrar's Representative will provide clarification and particulars regarding the contravention of subsection 45(1) of the Liquor Licence Act as alleged in the NOP as soon as possible.
