A M E N D I N G O R D E R
WHEREAS in its order dated February 17, 2009, the Board ordered disclosure pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, to be made ten (10) days before the hearing date;
AND WHEREAS the Licensee’s Representative, Adam Vassos, sought an amendment of the order to more accurately reflect the oral order made at the pre-hearing, as set out in his letter of February 17, 2009;
THEREFORE the Board hereby AMENDS the order to read as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 10 of AGCO Revised Rules of Practice and specifically pursuant to Rule 10.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 10.2, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure pursuant to Rule 10.3, including a list of its witnesses and a detailed summary of each witness’ evidence if not previously provided, as well as disclosure pursuant to Rule 10.2, ten (10) days before the hearing date.
The parties are to exchange their respective reports from each toxicologist at least ten (10) days before the first hearing date of March 17, 2009, all in accordance with Rule 12;
A further three days for the hearing will be scheduled, and at the request of Ms. Taylor, with the consent of Mr. Vassos, the first of these three days will take place in Toronto.
