D E C I S I O N
A hearing was commenced into Notice of Proposal number 16770 dated October 29, 2008, to revoke liquor licence number 11363 issued to 2078841 Ontario Ltd. ( the “Licensee”), operating as AIRPORT MOTOR INN, 1716 London Line Road, Sarnia, Ontario, N7T 7H2 (the “establishment” or the “premises”) on the basis of alleged violations of paragraphs 6(2)(a), 6(2)(d) and 6(2)(f) of the Liquor Licence Act was held on March 3, 2009 in the City of Sarnia.
Mr. Dan Alakas appeared as the Registrar’s representative.
Mr. Ravinder Sodhi, a principal of the corporate licensee, appeared on its behalf and waived its right to a legal representative.
Ms. Elizabeth Middleton was present on behalf of the Ministry of Finance.
Lengthy settlement discussions took place prior to the hearing commencing.
Preliminary Matters
The Mortgagee in possession of the premises, 1418057 Ontario Inc., represented by Mr. Paul Mand, was, on consent of the other parties, made a party to the proceedings.
The Board, on consent of all parties, adjourned the matter for a period of 30 days to allow time for Mr. Mand and Mr. Sodhi to work with Elizabeth Middleton of the Ministry of Finance to resolve the Retail Sales Tax matter at issue. The adjournment was granted on condition that if this matter is not resolved with the Ministry of Finance within the 30-day period, a new hearing date will be scheduled.
Mr. Dan Alakas is to inform the Hearings Department if the matter is not resolved within the 30-day period.
The Board hereby confirms its oral decision to grant the adjournment on the following condition:
This hearing will be scheduled for resumption if the Retail Sales Tax matter is not satisfactorily resolved with the Ministry of Finance by 5 p.m. on April 2, 2009.
