The Application
1The Registrar of the Alcohol and Gaming Commission of Ontario (AGCO) issued Notice of Proposal number 16330 dated May 29, 2008 to review an application for a liquor licence by 2147513 Ontario Limited (the “Applicant”) intending to operate as VICTORIA & ALBERT PUB II, 1921 Lawrence Avenue East, Scarborough, Ontario, M1R 2Y6, establishment number 20143. A hearing of the Application was held on July 31, 2008 in the City of Toronto.
Preliminary Matters
2Richard Kulis appeared on behalf of the Registrar. He advised the Registrar took no position on the public interest aspects of the hearing.
3Mr. Kulis stated that letters of objections and withdrawals have been filed with the AGCO. He requested that they be entered as exhibits. The letters were admitted as Exhibits #1 - #3.
4No objectors to the Application were in attendance at the hearing.
Conclusion
5Given that Registrar’s Representative is not taking a position and Exhibits #1-3 indicates that a number of residents who are neighbours had previously expressed concerns with the Application, and have now withdrawn their objections. Further, there were no objectors at the hearing. Based on the foregoing, the Board finds the onus on the objectors of the establishment that the licence is not in the public interest, has not been met.

6For the above reason the Board APPROVES the Application for liquor licence made by 2147513 Ontario Limited intending to operate as VICTORIA & ALBERT PUB II, 1921 Lawrence Avenue East, Scarborough, Ontario, M1R 2Y6, establishment number 20143, subject to all statutory conditions and municipal regulations.
