O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario ("AGCO") held a pre-hearing conference on September 15, 2008, pursuant to Notice of Proposal ("NOP") number 16358 dated June 2, 2008, to suspend a licence issued to 7 Lounge Inc. operating as SEVEN/RUNWAY 224, 224 Richmond Street West, Toronto, Ontario, M5V 1W2, liquor licence number 809662;
AND WHEREAS the Registrar's Representative, Richard Kulis, and Piero Suppa and Sam D'Uva, principals of the corporate licensee, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing October 27, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar's Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and statements for each witness, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar's Representative will complete any further disclosure and in particular, the notes of P.C. Troup, also pursuant to Rules 7.3 and 7.4, ten (10) days before the hearing date.
The parties are to advise the Board as soon as possible should a further proceeding arise which may affect the hearing scheduled for October 27, 2008.
