O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on July 24, 2008, pursuant to Notice of Proposal (“NOP”) number 15967 dated January 29, 2008 and NOP number 16240 dated April 30, 2008, to suspend a licence issued to 2076110 Ontario Ltd. operating as STROKERS SPORTS BAR & POOL, 14C Nelson Street West, Brampton, Ontario, L6X 1B7, liquor licence number 805319;
AND WHEREAS the Registrar’s Representative, Richard Kulis, the Licensee’s Representative, Marc Koplowitz, and the principal of the corporate licensee, Jinxiu Gao and her daughter Michelle who assisted as interpreter, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing August 28, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence if not already provided, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rules 7.3 and 7.4, ten (10) days before the hearing date.
Further, if the Registrar’s Representative intends to call Mr. Alakas (or any other person) as an expert in respect to the allegations of unlawful gambling, disclosure pursuant to Rule 7.6 shall be made no later than ten (10) days before the hearing date.
