O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on September 18, 2008, pursuant to Notice of Proposal (“NOP”) number 16308 dated May 21, 2008, to suspend a licence issued to Seawall Lounge Inc. operating as SEAWALL LOUNGE INC., 1067 Midland Avenue, Toronto, Ontario, M1K 1G7, liquor licence number 22873;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Randall Barrs, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing December 11, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses, statements for each witness, if available, or a detailed summary of their evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rules 7.3 and 7.4, ten (10) days before the hearing date.
