AND IN THE MATTER OF THE LIQUOR LICENCE OF 1472650 ONTARIO LTD. OPERATING AS RUMOURS SPORTS LOUNGE, 2787 EGLINTON AVENUE EAST, SCARBOROUGH LICENCE NO. 804900
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on October 2, 2008, pursuant to Notice of Proposal (“NOP”) number 15954 dated January 28, 2008, NOP number 16373 dated June 5, 2008, and Supplementary NOP number 16413 dated June 20, 2008, to revoke a licence issued to 1472650 Ontario Ltd. operating as RUMOURS SPORTS LOUNGE, 2787 Eglinton Avenue East, Scarborough, Ontario, M1J 2E1, liquor licence number 804900;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and the Licensee’s Representative, Randall Barrs, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing October 15, 2008 and to continue on October 16, 22 and 24, 2008;
AND WHEREAS a further NOP (number 16658) was issued on September 29, 2008 and the parties consent to joining this NOP with the other matters to be heard commencing October 15, 2008, subject to confirmation from Mr. Kulis regarding witness availability;
AND WHEREAS Mr. Kulis has advised that the Registrar withdraws the allegations of violations, on November 5 and 12, 2007, of subsection 45(1) of Ontario Regulation 719/90 (“O.Reg”) pursuant to the Liquor Licence Act (“LLA”) as set out in the NOP number 16373 dated June 5, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rules 7.3 and 7.4, ten (10) days before the hearing date.
