AND IN THE MATTER OF THE BOARD’S DECISION,
DATED JULY 8, 2008
A M E N D I N G O R D E R
WHEREAS in its decision dated July 8, 2008, the Board found the Licensee breached subsection 45(1) of Ontario Regulation 719/90 and imposed a ten (10) day suspension of the liquor licence to commence at 11:00 a.m. on August 25, 2008, and continue until 2:00 a.m. on September 4, 2008;
AND WHEREAS the Licensee, sought an amendment of the terms of the suspension in a letter dated July 11, 2008, and the Registrar's representative, Phillip Morris, consented to the proposed amendment in a letter dated July 21, 2008;
THEREFORE the Board hereby AMENDS the order dated July 8, 2008, to include paragraph 5 and to read as the following:
“5. Notwithstanding paragraph 4, The Board shall stay the suspension of the licence in respect to “the Pavilion” only from 4:00 p.m. on Saturday, August 30, 2008 until 1:00 a.m. on Sunday August 31, 2008 on the following conditions:
Julie Bissell and/or Rachel Ferrarotto (the permit holders) shall apply for a Special Occasion Permit in order to serve alcohol in the Pavilion to invited guests only;
The permit holders shall hire trained staff (whether or not employees of the licensee) who have a Board approved server training certification to serve liquor;
The licensee shall not sell or serve liquor at the event;
The licensee shall make no profit from the sale of liquor nor the employment
of its staff by the permit holders to serve liquor during the event.”
