O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission (“AGCO”) held a hearing on June 24, 2008, pursuant to a Notice of Proposal number 16116 dated March 13, 2008 to suspend a licence issued to 1186540 Ontario Inc. operating as RACK & Q, 63 – 67 Norfolk Street South, Simcoe, Ontario, N3Y 2W1, licence number 803510;
AND WHEREAS in its decision of July 23, 2008 the Board found that the Licensee had breached subsections 44(1) and 45(1) of Ontario Revised Regulation 719/90 under the Liquor Licence Act;
AND WHEREAS in its decision of September 17, 2008 the Board ordered a TEN (10) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to 1186540 Ontario Inc. operating as RACK & Q, 63 – 67 Norfolk Street South, Simcoe, Ontario, N3Y 2W1, licence number 803510, be SUSPENDED for ten (10) consecutive days to COMMENCE at 11:00 a.m. on December 1, 2008 and continue until 2:00 a.m. on December 11, 2008.
