O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing tele-conference on October 3, 2008, pursuant to Amended Notice of Proposal (“NOP”) number 16461 dated July 23, 2008, to suspend liquor licence number 812544 issued to 6681824 Canada Limited., operating as PHILTHY MCNASTY’S, 570 Kanata Avenue, Unit # R 6, Kanata, Ontario, K2T 1K5;
AND WHEREAS the Registrar’s Representative, Joyce Taylor, and the Licensee’s Representative, Jerry Levitan, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing October 30, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and will-say statements for each witness, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, specifically list of witness, outstanding notes of officers and will-say statements for each civilian witness, also pursuant to Rules 7.3 and 7.4, ten (10) days before the hearing date.
