The Application
1A hearing into Notice of Proposal (“NOP”) number 16483 dated July 23, 2008, to refuse to remove conditions on liquor licence number 24766 issued to 2050865 Ontario Inc., (the “Licensee”), operating as MYENG GA KOREAN RESTAURANT, 9712 Yonge Street, Richmond Hill, Ontario, L4C 1V9, was held on September 9, 2008 in the City of Toronto.
Preliminary Matters
2In a letter dated August 14, 2008, Registrar’s representative, Phillip Morris advised that the Registrar is not taking a position on the matter, did not anticipate being a party at the hearing and that counsel to the Registrar will not be attending the hearing.
3Su-Uk Lee is an officer and shareholder of the Licensee. He appeared on behalf of the Licensee and waived the right to legal representation. Ms Lee was assisted by an interpreter, Kenneth Kim.
Licensee’s Submissions
4Mr. Lee advised the Board that the Licensee is withdrawing its application for removal of conditions on the licence.
Decision
5The Board therefore ACCEPTS the withdrawal of the application for removal of conditions made by 2050865 Ontario Inc., operating as MYENG GA KOREAN RESTAURANT, 9712 Yonge Street, Richmond Hill, Ontario, L4C 1V9, liquor licence number 24766.
