O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on June 10, 2008, pursuant to Notice of Proposal (“NOP”) number 16273 dated May 21, 2008, to review an application for additional licensed areas by 1261224 Ontario Inc. operating as FILL STATION (THE), 2282 Queen Street East, Toronto, Ontario, M4E 1G6, liquor licence number 25241;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and the Licensee’s Representative, Maureen O’Neill-Pikol, assisted by Rob Gilroy, and the Representative of the City of Toronto, Jessica Braun, were present and participated in the pre-hearing;
AND WHEREAS the City of Toronto (the “City”) requested party status in respect of this matter;
AND WHEREAS Ms. O’Neill-Pikol consented to the request for party status and Mr. Kulis advised that the Registrar was not taking a position with respect to the request or the application at this time;
AND WHEREAS this NOP is scheduled for a hearing on June 30, 2008;
AND WHEREAS Ms. O’Neill-Pikol and Ms. Braun requested that the matter be rescheduled to a date in early July given concerns about potential witness availability;
THEREFORE the Board hereby ORDERS as follows:
The City of Toronto is hereby granted party status, as intervenor;
The hearing scheduled for June 30th is cancelled and is to be rescheduled to a date prior to July 14, 2008;
The City shall disclose to all other parties pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Licensee, through its Representative, shall complete any further disclosure, also pursuant to Rule 7.4, ten (10) days before the hearing date.
The Registrar’s Representative will provide disclosure, to the extent not already provided and/or available to, the City, also pursuant to Rule 7.4, ten (10) days before the hearing date.
