O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on September 15, 2008, pursuant to Notice of Proposal (“NOP”) number 16419 dated June 25, 2008, to suspend a licence issued to Easy & The Fifth Inc. operating as EASY & THE FIFTH, 221-225 Richmond Street West, Main Floor, Toronto, Ontario, M5V 1W2, liquor licence number 805425;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and the Licensee’s Representative, Gary Clewley, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing November 3, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence or, if available, statements for the witnesses, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, and in particular with respect to any civilian witness, statements, if received, or a detailed summary of each witness’ evidence, also pursuant to Rules 7.3 and 7.4, ten (10) days before the hearing date.
