O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on October 10, 2008, pursuant to Notice of Proposal (“NOP”) number 16631 dated September 12, 2008, to refuse to remove conditions on a licence issued to 1349425 Ontario Limited operating as EL BANDIDO, 393 King Street West, Toronto, Ontario, M5V 3G8, liquor licence number 803490;
AND WHEREAS the Registrar’s Representative, Richard Kulis, the Licensee’s Representative, Scott Turton, the Representative of City of Toronto, Jessica Braun, and the Representative of the residents of Condominium Corporation MTCC 1392 (the “Condominium”), Sonia Kociper, were present and participated in the pre-hearing conference;
AND WHEREAS the City of Toronto and the Condominium, through their representatives, requested party status in this matter, to which Mr. Turton and Mr. Kulis consented;
AND WHEREAS Mr. Turton requested a deferral of the hearing to permit time for a negotiated resolution of this matter, to which all parties consented;
THEREFORE the Board hereby ORDERS as follows:
- The City of Toronto is hereby granted party status, as intervenor;
- The Condominium is hereby granted party status;
- The Licensee, through its Representative, is to advise forthwith if an agreement is reached among the parties, failing such advice the Hearings office will, in January, 2009, contact the parties to schedule a further pre-hearing and the hearing in this matter.
