A hearing into Notice of Proposal number 16716 dated October 9, 2008 to revoke a liquor licence and an Order by the Registrar dated October 9, 2008 to immediately suspend liquor license number 812457 issued to 896807 Ontario Limited (the “Licensee”) operating as CLUB 147, 57 Mountjoy Street South, Upper Level, Timmins, Ontario, P4N 1S6 (the “Premises”), on the basis of an alleged violation of section 6 of the Liquor Licence Act (“LLA”) and subsection 45(1) and section 45.2 of Ontario Regulation 719/90 (“O.Reg”) made pursuant to the LLA, commenced on October 24, 2008 in the City of Timmins.
The Board has grave concerns about the events that allegedly took place at the Premises on October 4, 2008. The public safety is of paramount importance to the Board.
On October 9, 2008 the Registrar ordered the interim suspension of the Licensee’s licence in the interest of public safety and subject to an Order of the Board of the Alcohol and Gaming Commission of Ontario (the “Interim Suspension”).
The Board is sympathetic to the financial hardships posed by the Licensee, but is of the view that the public safety concern is paramount.
The Board wishes to hear all of the Licensee’s evidence, prior to deciding on whether to lift the interim suspension.
Order
- Therefore, the Board, based on the serious allegations before it, CONFIRMS its oral ORDER that it is in the public interest that the Interim Suspension currently in place on licence number 812457 issued to 896807 Ontario Limited operating as CLUB 147, 57 Mountjoy Street South, Upper Level, Timmins, Ontario, P4N 1S6, remains in effect until the end of the next hearing date of November 14, 2008, at which time its continuation will be re-considered upon request by the parties.
