O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on July 18, 2008, pursuant to Notice of Proposal (“NOP”) number 16140 dated March 27, 2008, to suspend a licence issued to Arena Entertainment Inc. operating as CIRCA, 126 John Street, Toronto, Ontario, M5V 2E3, liquor licence number 807407;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Jerry Levitan, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing August 14, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar's Representative pursuant to Rule 7 of the AGCO Rules of Practice, and specifically pursuant to Rule 7.3, a list of its witnesses together with a detailed summary of each witness' evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar's Representative will complete any further disclosure, also pursuant to Rule 7.4, and specifically pursuant to Rule 7.3, a list of its civilian witnesses together with a detailed summary of each such witness' evidence, such disclosure to be made ten (10) days before the hearing date.
