O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on July 7, 2008, pursuant to Notice of Proposal (“NOP”) number 16210 dated May 2, 2008, to suspend a licence issued to Timcoe Restaurant Services Ltd. operating as BOSTON PIZZA, 25 Queensway West, Simcoe, Ontario, N3Y 2M7, liquor licence number 812575;
AND WHEREAS the Registrar’s Representative, Brad Alton, and the Licensee’s Representative, George Limberis, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing September 25, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., and without limitation, Detective Constable Verberne’s and Detective Constable Dunn’s notes, as well as R. Fody’s notes or, if there are no such notes, then a detailed summary of this witness’ evidence, ten (10) days before the hearing date.
