O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission (“AGCO”) held a hearing into a Notice of Proposal number 14927 dated February 7, 2007 to suspend liquor license number 90114 issued to 2008221 Ontario Inc. operating as PILOT TAVEN, 22 Cumberland Street, Toronto, Ontario, M4W 1J5, on the basis of alleged violations of section 52 and subsection 45(1) of Ontario Regulation 719/90 (“O.Reg”) made pursuant to the Liquor Licence Act (“LLA”) on June 26 and July 23, 2007 in the City of Toronto.
AND WHEREAS in its decision of November 1, 2007 the Board found that the Licensee had breached subsection 45(1) of the O.Reg under the LLA. The Registrar withdrew the allegations based on section 52 of the O.Reg. In its Order dated January 21, 2008, the Board ordered the liquor licence be suspended for FIVE (5) consecutive days;
AND WHEREAS the licence holder appealed the Board’s decision to the Ontario Superior Court of Justice (Divisional Court) and by an Order, the Court stayed the period of suspension of the licence pending the outcome of the appeal;
AND WHEREAS the appeal was dismissed by the Divisional Court by an Oral Order on September 15, 2008;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to 2008221 Ontario Inc. operating as PILOT TAVEN, 22 Cumberland Street, Toronto, Ontario, M4W 1J5, licence number 90114, be SUSPENDED for FIVE (5) consecutive days to COMMENCE at 11 a.m. on November 8, 2008 and continue until 2 a.m. on November 13, 2008.
