O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on January 15, 2008, pursuant to Notice of Proposal (“NOP”) number 15758 dated November 15, 2007, to suspend a licence issued to 1210733 Ontario Inc., operating as Up & Down Bar Lounge, 290 Adelaide Street West, Toronto, Ontario, M5H 1X6, liquor licence number 802333;
AND WHEREAS the Registrar’s Representative, Phillip Morris, was present, and a Representative for the Licensee did not attend the pre-hearing conference;
AND WHEREAS this NOP matter is scheduled for a hearing commencing February 13, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made fourteen (14) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., fourteen (14) days before the hearing date.
