O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on February 8, 2008, pursuant to Notice of Proposal (“NOP”) number 15641 dated November 27, 2007, to suspend a licence issued to 1496860 Ontario Inc. operating as THE ROOSTER, 172 Simcoe Street, Peterborough, Ontario, K9H 2H7, liquor licence number 92311;
AND WHEREAS the Registrar’s Representative, Richard Kulis, and the Licensee’s Representative, Ed Blaha, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing March 19, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made: (a) with respect to the events alleged to have occurred in the NOP on November 19, 2006 by March 1, 2008; and (b) with respect to the event alleged to have occurred on December 16, 2006, ten (10) days before the first hearing date, being March 19, 2008;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
