A M E N D I N G O R D E R
WHEREAS in its decision dated November 14, 2007, the Board, having made findings under subsection 30(4) of the Liquor Licence Act and subsection 45(1) of Ontario Regulation 719/90, imposed a forty-five (45) day suspension of the liquor licence;
AND WHEREAS Licensee’s Representative, Jeff Leibermann, sought an amendment of the dates for reasons contained in his letter of January 23, 2008 and the Registrar's representative, Richard Kulis has consented to the proposed amendment in an email dated January 24, 2008;
THEREFORE the Board hereby AMENDS the suspension dates on page 3 of the Board’s order dated November 14, 2007 to read as follows:
“Therefore, having considered the Joint Submission on Disposition, the Board confirms its oral ORDER that the liquor licence issued to PM Kingston Inc., operating as Philthy McNasty’s, 506 Princess Street, Kingston, Ontario, K7L 1C5, be SUSPENDED for FORTY-FIVE (45) consecutive days to COMMENCE at 11:00 a.m. on January 2, 2008, and CONTINUE until 2:00 a.m. on February 16, 2008.”
