O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on January, 2008, pursuant to Notice of Proposal (“NOP”) number 15736 dated January 4, 2008, to suspend a licence issued to Late Night Inc., operating as New January Family Restaurant, 603 Kennedy Road, Scarborough, Ontario, M1K 2B2, liquor licence number 200332;
AND WHEREAS the Registrar’s Representative, Daniel Alakas, the Licensee’s Representative, Michael Booth, were present and participated in the pre-hearing;
AND WHEREAS the parties requested that this NOP matter, which was scheduled to proceed on February 11, 2008, be rescheduled to proceed on February 29, 2008;
THEREFORE, on consent of the parties, the Board hereby ORDERS as follows:
- This matter is adjourned to Friday, February 29, 2008 at 9:30 a.m. for a hearing;
FURTHER, the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
