Allegations
- A hearing into an Order of Immediate Suspension dated April 21, 2008 to suspend the registration of Subaeasan Poopalasingam Suban Trustway Limited operating as One Stop Shopping Convenience, 30 Park Road North, Unit 3, Oshawa, Ontario, L1J 4K7, as a gaming supplier, file number 142028, on the basis that the Registrar considers it to be necessary in the public interest to immediately suspend the registration, was held on August 12, 2008, in the City of Toronto.
Preliminary Matters
Registrar’s counsel submitted that on May 22, 2008, Mr. Subaeasan Poopalasingam sold the business operated as One Stop Shopping Convenience and his contract with the Ontario Lottery and Gaming Corporation (“OLG”) was thereby terminated. As a result, pursuant to subsection 9(4) of Ontario Regulation 281/07 made pursuant to the Gaming Control Act (“GCA”), his registration as a lottery retailer was terminated. The new owner now has a contract with the OLG and is registered as a gaming supplier.
Mr. Poopalasingam is still registered as a break open ticket seller. The GCA requires that the registration be posted at the location and tickets be sold at the location for which the registration applies. Mr. Poopalasingam is no longer compliant with the GCA because he no longer owns the business.
On consent, the Order of Immediate Suspension dated April 21, 2008 is to be kept in place until the Registrant surrenders his registration as a break open ticket seller.
Furthermore, the Deputy Registrar consents to amend the condition on the new owner’s registration to allow Mr. Poopalasingam to act as a clerk to sell and redeem tickets which is at present prohibited. He will still have no ownership or management powers.
Decision & Order
- Based on the agreement of the parties, the Board hereby CONFIRMS its ORAL ORDER that the Order of Immediate Suspension dated April 21, 2008 is to remain in place until the registration of Subaeasan Poopalasingam Suban Trustway Limited operating as One Stop Shopping Convenience, 30 Park Road North, Unit 3, Oshawa, Ontario, L1J 4K7, as a break open ticket seller is SURRENDERED and the CONDITION on the registration of the new owner, Gowseelan Kanagaratnam, now prohibiting Mr. Poopalasingam’s involvement, is AMENDED to allow Mr. Poopalasingam to act as a clerk to sell and redeem tickets.
