O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on May 30, 2008, pursuant to Notice of Proposal (“NOP”) number 16096 dated March 12, 2008, to suspend a licence issued to 501250 Ontario Inc. operating as WALLY’S ROADHOUSE, 2532 – 2536 Innes Road, Gloucester, Ontairo, K1B 4C5, liquor licence number 20092;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Roger Button, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing August 28, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date, in particular, any notes of police officers who will be attending the hearing as witnesses and disclosure regarding breathalyser tests if the Registrar intends to rely upon that evidence. Further, the Board notes Mr. Morris undertaking to provide Sylvie Gauvin’s particulars if that information is within the Registrar’s file.
