DATED MAY 23, 2008

A M E N D I N G O R D E R

WHEREAS in its order dated May 23, 2008, the Board ordered disclosure pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, to be made twenty-one (21) days before the hearing date;

AND WHEREAS Registrar’s Representative, Phillip Morris, sought an amendment of the order to more accurately reflect the oral order made at the pre-hearing, as set out in his letter of May 27, 2008;

THEREFORE the Board hereby AMENDS the order to read as follows:

1. The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and “will-says” or witness statements for each witness, as well as disclosure pursuant to Rule 7.4, such disclosure to be made twenty-one (21) days before the hearing date;”

2. The Licensee, through its Representative, shall advise Registrar’s Representative whether Ms. T. Lyle will be called as a witness at least fourteen (14) days before the hearing date.

3. The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4, twenty-one (21) days before the hearing date.
