AND IN THE MATTER OF THE BOARD’S DECISION,

DATED APRIL 9, 2008

A M E N D I N G O R D E R

WHEREAS in its decision dated April 9, 2008 the Board found the Licensee breached sections 16 and 29 of the Liquor Licence Act and section 29 and subsection 45(1) of Ontario Regulation 719/90 and imposed a THIRTY (30) day suspension of the liquor licence to commence at 11:00 a.m. on May 26, 2008 and continue until 2:00 a.m. on June 25, 2008;

AND WHEREAS Licensee’s representative advised in his letter dated April 18, 2008 that he provided incorrect dates for the suspension period and therefore seeks an amendment of the dates, and further, Registrar's representative has consented to the proposed amendment;

AND WHEREAS the amended suspension dates are acceptable to the Board;

THEREFORE the Board AMENDS paragraph 4 of the Board’s decision dated April 9, 2008 to read as follows:

Therefore, having considered the Joint Submission on Disposition, the Board confirms its oral ORDER that the liquor licence issued to Late Night Inc. operating as NEW JANUARY FAMILY RESTAURANT, 603 Kennedy Road, Scarborough, Ontario, M1K 2B2, be SUSPENDED for THIRTY (30) consecutive days to COMMENCE at 11:00 a.m. on June 27, 2008, and CONTINUE until 2:00 a.m. on July 27, 2008.
