AND IN THE MATTER OF THE LIQUOR LICENCE OF 2006546 ONTARIO INC. OPERATING AS CLINTON’S, 693 BLOOR STREET WEST, TORONTO LICENCE NO. 809593
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on May 2, 2008, pursuant to Notice of Proposal (“NOP”) number 15881 dated December 20, 2007 and NOP number 16139 dated March 27, 2008, to suspend a licence issued to 2006546 Ontario Inc. operating as CLINTON’S, 693 Bloor Street West, Toronto, Ontario, M6G 1L5, liquor licence number 809593;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Jerry Levitan, were present and participated in the pre-hearing;
AND WHEREAS these matters will be heard at a hearing as yet to be scheduled;
THEREFORE the Board hereby ORDERS as follows:
The Licensee’s Representative undertakes to disclose to the Registrar’s Representative any case law on the issue of trespass by an Inspector, if found by him, as soon as possible.
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
