1A hearing of the Alcohol and Gaming Commission of Ontario (“AGCO”) was held in Ottawa on December 6, 2007, January 3, February 5, 6,19 and 29, 2008 with respect to liquor licence number 805651 issued to 1694062 Ontario Inc. (the “Licensee”) operating as BRIG BRITISH PUB, KANATA (THE), 655 Terry Fox Drive, Kanata, Ontario, K2L 4E7 concerning:
(i) an Order dated November 20, 2007 to immediately suspend a liquor licence on an interim basis;
(ii) a Notice of Proposal number 15784 dated November 20, 2007; and
(iii) a Supplementary Notice of Proposal dated November 27, 2007
on the basis of alleged violations of clause 6(2)(g.1) of the Liquor Licence Act (“LLA”) and subsection 45(1) and sections 29, 33, 45.2 of Ontario Regulation 719/90 (“O.Reg”) made pursuant to the LLA. Three further hearing dates were scheduled for March and April 2008.
2By letter dated March 5, 2008, the Licensee advised the AGCO that it was voluntarily surrendering its licence. The Registrar’s representative subsequently wrote to the Board, in a letter dated March 12, 2008, to advise the Registrar had cancelled licence number 805651 and therefore requesting that the hearing dates be cancelled.
3Inquiries by Hearings department staff, at the Board’s request, determined that the Notices of Proposal have been withdrawn.
4In all the circumstances, the Board cancelled the outstanding hearing dates and ORDERS that the hearing file in this matter is closed.
