O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on May 30, 2008, pursuant to Notice of Proposal (“NOP”) number 16241 dated May 2, 2008, to review an application for licence for additional licensed areas made by 2042287 Ontario Inc. operating as BLURR NIGHT CLUB, 214/216 Adelaide Street, Toronto, Ontario, M5H 1W7, liquor licence number 804312;
AND WHEREAS the Registrar’s Representative, Phillip Morris, the Licensee’s Representative, Jerry Levitan, the Representative of the City of Toronto, Ray Kallio, and the Representative of the King-Spadina Residents Association (“KSRA”), Wayne Scott, were present and participated in the pre-hearing conference;
AND WHEREAS the City of Toronto requested party status in respect of this matter;
AND WHEREAS the KSRA requested party status in respect of this matter;
AND WHEREAS Mr. Levitan consented to the requests for party status and Mr. Morris advised that the Registrar was not taking a position with respect to the application at this time;
AND WHEREAS this NOP matter is scheduled for a hearing commencing June 12, 2008;
THEREFORE the Board hereby ORDERS as follows:
The City of Toronto is hereby granted party status, as intervenor;
The KSRA is hereby granted party status;
The City of Toronto shall disclose to all parties pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The KSRA shall disclose to all parties pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Licensee, through its Representative, shall complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date;
The Registrar’s Representative will provide disclosure to the representatives of the City and the KSRA, also pursuant to Rule 7.4., ten (10) days before the hearing date.
