AND IN THE MATTER OF THE LIQUOR LICENCE OF BLACK BULL PUB AND EATERY LTD. OPERATING AS BLACK BULL PUB AND EATERY LTD., 62 QUEEN STREET NORTH, BOLTON LICENCE NO. 91310
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on May 23, 2008, pursuant to Notice of Proposal (“NOP”) number 16188 dated April 10, 2008, to suspend a licence issued to Black Bull Pub and Eatery Ltd. operating as BLACK BULL PUB AND EATERY LTD., 62 Queen Street North, Bolton, Ontario, L7E 1B9, liquor licence number 91310;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Sam Sasso, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing July 28, 2008;
AND WHEREAS the representatives have advised that paragraph 4(b) of the NOP cites subsection 45.1 of the Liquor Licence Act (“LLA”) in error, and that section 45.1 of Ontario Regulation 719/90 under the LLA should be referenced;
THEREFORE the Board hereby ORDERS as follows:
The NOP shall be amended to reference an allegation under section 45.1 of Ontario Regulation 719/90 under the LLA;
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and “will-says” or witness statements for each witness, as well as disclosure pursuant to Rule 7.4, such disclosure to be made fourteen (14) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4, fourteen (14) days before the hearing date.
