Allegations
- A hearing into a Notice of Proposal (NOP) number 15695, dated October 16, 2007, to revoke liquor license number 280843 issued to 1100947 Ontario Inc., operating as THE KILT AND CLOVER, 17 – 19 Lock Street, St. Catharines, Ontario, L2N 5B6, on the basis that the licence holder would be disentitled to a licence under section 6 of the Liquor Licence Act (LLA), was held on January 29, 2008, in the City of Niagara Falls.
Preliminary Matters
- David Dwight Prentice appeared on behalf of Shannon Lynn Prentice, who is his wife and the principal of the licensee. He waived its right to legal representation.
Decision and Order
The Board was advised by Mr. Alakas that the Licensee’s outstanding retail sales tax debt, totalling $141,036, had been remitted in full to the Minister of Revenue the previous day and that all returns had been filed by it. As a result, the Licensee’s Retail Sales Tax account was up-to-date as of the date of the hearing. Mr. Sean Kirkey, present as a representative of the Minister of Revenue, confirmed this information. Mr. Alakas thus requested that the NOP be withdrawn, there being no other allegations in it. Mr. Prentice concurred with this request.
In the circumstances, the Board ACCEPTS the Registrar’s request that the Notice of Proposal number 15695, dated October 16, 2007, to revoke liquor license number 280843 issued to 1100947 Ontario Inc., operating as THE KILT AND CLOVER, 17 – 19 Lock Street, St. Catharines, Ontario, L2N 5B6, is WITHDRAWN.
