O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on March 7, 2008, pursuant to Notice of Proposal (“NOP”) number 15849 dated December 13, 2008, to suspend a licence issued to El Mocambo Rocks Inc. operating as EL MOCAMBO ROCKS, 464 Spadina Avenue, Toronto, Ontario, M5T 2G8, liquor licence number 90105;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Jerry Levitan, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing April 15, 2008;
AND WHEREAS at the time of the pre-hearing, the Representatives advised that they were not aware of any procedural issues for the hearing, without precluding themselves from raising any such issues subsequently. Procedural issues that arise or come to the attention of the Representatives prior to the hearing are to be disclosed by way of motion, where required by the Rules;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date; and
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
