O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a hearing on January 21, 2008 pursuant to a Notice of Proposal number 15485 dated August 2, 2007, to suspend liquor licence number 806133 issued to Club Gabella Inc. operating as Club Gabella Inc., 574 Rogers Road, Toronto, Ontario, M6M 1B6;
AND WHEREAS in its decision dated March 12, 2008, the Board found that the licensee had breached subsection 45(1) of Ontario Regulation 719/90, made pursuant to the Liquor Licence Act;
AND WHEREAS the Board ordered a suspension of the liquor licence for twenty-one (21) consecutive days and requested that the licensee propose suspension dates;
AND WHEREAS the licensee has not proposed suspension dates within the time frame required;
AND WHEREAS Panel Member Monteith has resigned from his duties and responsibilities as a Member of the AGCO Board effective March 29, 2008, and was therefore unable to participate in making this order. The remaining Panel Member, Vice-Chair McQuaid, has rendered the order in this matter pursuant to subsection 4.4(1) of the Statutory Powers Procedures Act.
THEREFORE the Board hereby ORDERS that the liquor licence issued to Club Gabella Inc., operating as Club Gabella Inc., 574 Rogers Road, Toronto, Ontario, M6M 1B6, be SUSPENDED for TWENTY-ONE (21) consecutive days to COMMENCE at 11a.m. on April 21, 2008 and continue until 2:00 a.m. May 12, 2008.
