AND IN THE MATTER OF THE LIQUOR LICENCE OF TINKER’S BILLIARDS & BAR INC. OPERATING AS TINKER’S BILLIARDS & BAR, 17-19 RENFREW AVENUE WEST, RENFREW LICENCE NO. 805904
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on March 7, 2008, pursuant to Notice of Proposal (“NOP”) number 15937 dated January 15, 2008, to suspend a licence issued to Tinker’s Billiards & Bar Inc. operating as TINKER’S BILLIARDS & BAR, 17-19 Renfrew Avenue West, Renfrew, Ontario, K7V 2X8, liquor licence number 805904;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and James Barkey, the principal of the corporate licensee, were present and participated in the pre-hearing;
AND WHEREAS this NOP matter is scheduled for a hearing commencing May 21, 2008;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a detailed summary of each witness’ evidence. If witness statements are or will be available, those are to be provided pursuant to the Rule. As well, disclosure pursuant to Rule 7.4 is to be made ten (10) days before the hearing date, and including a copy of any recording of telephone messages or conversations, on which the Licensee intends to rely;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
