O R D E R
WHEREAS a hearing into a Notice of Proposal dated November 27, 2007, to suspend liquor licence number 92311 (the “Licence”) issued to 1496860 Ontario Inc., (the “Licensee”) operating as THE ROOSTER (“Rooster’s”), 172 Simcoe Street, Peterborough, Ontario, K9H 2H7, (the “Premises”), on the basis of alleged violations of subsection 34(1) of the Liquor Licence Act (LLA) and subsection 45(1) of Ontario Regulation 719/90 (O.Reg) made pursuant to the LLA, was held on March 19, 20 and 25, 2008, in the City of Peterborough;
AND WHEREAS in its decision of June 30, 2008 the Board found that the Licensee had breached subsection 45(1) of the O.Reg on December 16, 2006, and dismissed the allegation of a violation of subsection 45(1) of the O.Reg on November 19, 2006;
AND WHEREAS in its decision of October 23, 2008 the Board ordered a SEVEN (7) day suspension of the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to 1496860 Ontario Inc., operating as THE ROOSTER, 172 Simcoe Street, Peterborough, Ontario, K9H 2H7, licence number 92311, be SUSPENDED for SEVEN (7) consecutive days to COMMENCE at 11:00 a.m. on December 17, 2008 and continue until 2:00 a.m. on December 24, 2008.
