Notice of Proposal: To REFUSE to remove conditions Dated December 19, 2006
The Deputy Registrar of the Commission has considered the application and the objections and has directed this proposal to refuse to remove the conditions from the licence because:
(a) The Commission has received written objections to the removal of the conditions from the residents of the immediate area of the establishment.
(b) There has been no change in circumstances to justify the removal of the conditions.
(c) The past/present conduct of the applicant (or if a corporation) or its officers or directors, or a shareholder who owns or controls 10% or more of its equity shares, or a person having beneficial interest in the business, or a person having responsibility for the management or operation of the business affords reasonable grounds for belief that its business will not be carried on in accordance with the law and with integrity and honesty.

D E C I S I O N and O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a hearing on February 19, 2007 pursuant to a Notice of Proposal dated December 19, 2006 to refuse to remove conditions #2 and #6 from the licence issued to 1548710 Ontario Inc. for premises operating as Mink Nightclub, 150 Pearl Street, Toronto, Ontario, M5H 1L3, licence number 200726;
AND WHEREAS the corporate licensee was represented by legal counsel Adam Vassos;
AND WHEREAS the hearing proceeded by way of a written Consent (Exhibit #1) submitted by the counsel for the Registrar and counsel for the corporate licensee, which is attached hereto and forms part of this decision, and which was signed by 2 representatives (Messrs. Wayne Scott and Don Rodbard) of the King-Spadina Residents’ Association;
THEREFORE having considered the Consent, the Board hereby confirms its oral ORDER that conditions #2 and #6 attached to licence number 200726 be repealed and replaced by the following conditions:
#2 – At all times while the establishment is open and for at least an hour after the establishment has closed the establishment shall be staffed with at least one visibly identifiable security guard for every 100 patrons in the establishment.
#6 - The licensee will not permit any “Rave” or “Rave-style” events which are marketed and promoted to minors to occur within the licensed premises.

CONSENT
I, 1548710 Ontario Inc., holder of liquor licence #200726, do hereby consent to the following changes to the conditions that are attached to said liquor licence.
We, representatives of the King- Spadina Residents’ Association, do hereby consent to the following changes that are attached to liquor licence #200726.
CURRENT CONDITIONS
#2 ON THURSDAY, FRIDAY AND SATURDAY NIGHTS FROM 10 P.M. TO 3 A.M. THE LICENSEE SHALL HAVE 4 READILY IDENTIFIABLE SECURITY PERSONNEL LOCATED OUTSIDE THE MAIN DOORS
#6 NO MINORS ARE PERMITTED ON THE PREMISES AFTER 10:00 P.M.
REVISED CONDITIONS
#2 AT ALL TIMES WHILE THE ESTABLISHMENT IS OPEN AND FOR AT LEAST AN HOUR AFTER THE ESTABLISHMENT HAS CLOSED THE ESTABLISHMENT SHALL BE STAFFED WITH AT LEAST ONE VISIBLY IDENTIFIABLE SECURITY GUARD FOR EVERY 100 PATRONS IN THE ESTABLISHMENT.
#6 THE LICENSEE WILL NOT PERMIT ANY “RAVE” OR “RAVE-STYLE” EVENTS WHICH ARE MARKETED AND PROMOTED TO MINORS TO OCCUR WITHIN THE LICENSED PREMISES.
