O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on February 2, 2007 pursuant to a Notice of Proposal dated November 14, 2006 and a Supplementary Notice of Proposal dated January 12, 2007 to revoke a licence issued to 1475750 Ontario Limited operating as West Side B.B.Q., 853A Bloor St. W., Toronto, Ontario, M6G 1M3, licence number 200621;
AND WHEREAS the Registrar was represented by his counsel, Joyce Taylor, the corporate licensee was represented by its counsel, Lou Ciotoli and the City of Toronto was represented by its counsels, Ray Kallio and Jessica Braun;
AND WHEREAS the City of Toronto requested to be granted party status in respect of the hearing pursuant to the Notices of Proposal dated November 14, 2006 and January 12, 2007 which was consented to by the Registrar’s counsel and by the Licensee’s counsel;
AND WHEREAS counsel for the corporate licensee requested an adjournment of the hearing which was granted by the Board on consent of both Registrar’s counsel and counsel for the City of Toronto, so that new dates for the hearing are to be canvassed forthwith.
THEREFORE the Board hereby ORDERS as follows:
- The City of Toronto shall be added as a party immediately;
- The City of Toronto shall disclose to the parties pursuant to rule 7 of AGCO Rules of Practice and specifically pursuant to Rules 7.3 and 7.4, a list of its witnesses, a summary of each witness’ evidence, and copies of any documents to be produced in evidence, such disclosure to be made as early as possible but no later than ten (10) days before the hearing date;
- The licence-holder shall disclose to the parties, pursuant to rule 7 of AGCO Rules of Practice and specifically pursuant to Rules 7.3 and 7.4, a list of its witnesses, a summary of each witness’ evidence, and copies of any documents to be produced in evidence, such disclosure to be made as early as possible but no later than ten (10) days before the hearing date;
- Registrar’s counsel will disclose to the City of Toronto immediately all documents previously disclosed to the licence holder and will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
