AND IN THE MATTER OF THE LIQUOR LICENCE OF ELGIN STREET HOLDINGS INC., OPERATING AS LIEUTENANT’S PUMP RESTAURANT, 361 ELGIN STREET, UNIT 1, OTTAWA, LICENCE NO. 200346
O R D E R
WHEREAS the Registrar of the Alcohol and Gaming Commission of Ontario (“AGCO”) issued Notice of Proposal number 15673 dated September 31, 2007 to suspend a licence issued to Elgin Street Holdings Inc., operating as Lieutenant’s Pump Restaurant, 361 Elgin Street, Unit 1, Ottawa, Ontario, K2P 1M6, licence number 200346;
AND WHEREAS the Licensee’s Representative, Gordon Douglas, requested disclosure regarding Inspector Mark Lambert in a letter dated December 21, 2007 or a pre-hearing conference to consider the issues relating to disclosure and the exchange of information between parties.
AND WHEREAS the Registrar’s Representative, Joyce Taylor, requested an Order of Disclosure be issued in a letter dated December 24, 2007, and copied to Gordon Douglas, Licensee’s Representative;
AND WHEREAS these matters are scheduled for a hearing commencing January 8, 2008 and given the date of the requests, there is not sufficient time to schedule a pre-hearing conference;
THEREFORE the Board hereby ORDERS as follows:
The parties shall disclose to each other, pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made by January 3, 2008;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., by January 3, 2008;
Any motions regarding further disclosure requested by the Licensee’s Representative in the letter of December 21, 2007 and by the Registrar’s Representative in the letter of December 24, 2007 may be argued before the Panel on the date of the hearing.
