Allegations
- A hearing into a Notice of Proposal number 15651 dated September 14, 2007 to revoke a liquor licence and an Order dated September 14, 2007 as amended September 21, 2007 to immediately suspend a liquor license on an interim basis to liquor licence number 92427 issued to Darchris Productions Inc. operating as SOLID GOLD ADULT ENTERTAINMENT, 398 Clarence Street, London, Ontario, N6A 3M7, on the basis of alleged violation of clause 6(2)(d) and subsection 45(1) and 45(2) of the Liquor Licence Act ("LLA") and subsection 45.1 of Ontario Regulation 719/90 (“O.Reg”) made pursuant to the LLA, was held on October 3 and 4, November 8, 9, 14,15 and 16, 2007 in the city of London and on December 10, 2007 in the city of Toronto.
Order
After concluding the evidence and hearing submissions into allegations, the Licensee asked the Board to rescind Interim Suspension order made pursuant to section 15(6) of the LLA. Registrar’s representative took the position the suspension should remain in effect.
The Board is satisfied, based on the evidence that is before it, there is no ongoing concern for public safety and that the suspension is no longer “necessary in the public interest”.
Therefore, the Board RESCINDS the suspension of the licence number 92427 issued to Darchris Productions Inc. operating as SOLID GOLD ADULT ENTERTAINMENT, 398 Clarence Street, London, Ontario, N6A 3M7. Further, the Board ORDERS that Liquor Licence number 92427 is in full force and effect commencing Wednesday, December 12, 2007 at 11:00 a.m. subject to any and all pre-existing conditions on the licence.
