O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission (“AGCO”) held a hearing into a Notice of Proposal number 14335 dated August 3, 2006 to revoke liquor license number 800727 (the “Licence”) issued to 1132959 Ontario Ltd. operating as NRG/KINGDON NIGHT CLUB, 1400 Plains Road East, Burlington, Ontario, L7R 3P8, on the basis of alleged violations of subsections 45(1), 45(2) and 34(1) of Ontario Regulation 719/90 (“O.Reg”) made pursuant to the Liquor Licence Act (“LLA”) and Supplementary Notices of Proposal dated January 12, 2007 and February 19, 2007 to revoke the Licence on the basis of an alleged violation of section 29 of the LLA, was held May 1, 2, 3, 2007 and June 28, 29, 2007 in the City of Burlington;
AND WHEREAS in its decision of October 22, 2007 the Board found that the Licensee had breached numerous violations of section 29 of the LLA and subsections 34(1), 45(1) and 45(2) of the O.Reg;
AND WHEREAS in its decision of November 29, 2007 the Board ordered a FORTY-FIVE (45) day suspension on the liquor licence and requested that the Licensee propose suspension dates;
AND WHEREAS the Licensee has proposed suspension dates which are acceptable to the Board;
THEREFORE the Board hereby ORDERS that the liquor licence issued to 1132959 Ontario Ltd. operating as NRG/KINGDON NIGHT CLUB, 1400 Plains Road East, Burlington, Ontario, L7R 3P8, license number 800727, be SUSPENDED for FORTY-FIVE (45) consecutive days to COMMENCE at 11 a.m. on January 14, 2008 and continue until 2 a.m. on February 28, 2008.
