AND IN THE MATTER OF AN APPLICATION TO TRANSER LICENCE BY ROSSTON NIGEL EDWARDS OPERATING OR INTENDING TO OPERATE AS RISTON’S RESTAURANT BAR AND LOUNGE NOTICE OF PROPOSAL NUMBER 15470
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on November 9, 2007 pursuant to Notice of Proposal number 15443 dated July 11, 2007 to suspend the licence issued to The N-One Azteca Sports Inc., operating as Beautiful Centroamerica, 1738 St. Clair Avenue West, Toronto, Ontario, M6N 1J3, licence number 810383;
AND WHEREAS in the matter of an application to transfer licence pursuant to Notice of Proposal number 15470 dated July 23, 2007 to refuse to transfer a licence issued to The N-One Azteca Sports Inc., operating as Beautiful Centroamerica, 1738 St. Clair Avenue West, Toronto, Ontario, M6N 1J3, licence number 810383 to Rosston Nigel Edwards operating as or intending to operate as Riston’s Restaurant Bar and Lounge;
AND WHEREAS the Registrar’s Representative, Phillip Morris, was present, and a representative for the Licensee and a representative for the applicant did not attend the pre-hearing;
AND WHEREAS these matters are scheduled for a hearing commencing December 6, 2007;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
