WHEREAS the Registrar issued a Notice of Proposal dated October 18, 2007 to revoke liquor licence number 202449 issued to 1254667 Ontario Inc., operating as Mr. Bob’s Gourmet Pizza, 665 The Queensway, Units 1-4, Peterborough, Ontario;
AND WHEREAS on October 18, 2007 the Registrar issued an immediate suspension of that liquor licence pursuant to subsection 15(6) of the Liquor Licence Act;
AND WHEREAS the Registrar issued a Notice of Proposal dated October 19, 2007 to revoke liquor delivery licence number 52103 issued to 1254667 Ontario Inc., operating as K & T Deliveries (LDS), 671 Cameron Street, Peterborough, Ontario;
AND WHEREAS on October 19, 2007 the Registrar issued an immediate suspension of that liquor delivery licence pursuant to subsection 15(6) of the Liquor Licence Act;
AND WHEREAS the Licensee has filed requests for hearing of the Notices of Proposal dated October 30, 2007 with the Board and the Board proposed November 5, 6, and 7, 2007 as hearing dates in the matter which were not convenient to Jeffrey D. Ayotte, the Licensee’s Representative;
AND WHEREAS the Licensee’s Representative, and Richard Kulis, Registrar’s Representative, agreed to continue the interim suspension of the liquor licence and the liquor delivery licence until the Licensee was able to proceed with the hearing;
THEREFORE, the Board ORDERS the interim suspensions of liquor licence number 202449 issued to 1254667 Ontario Inc., operating as Mr. Bob’s Gourmet Pizza, 665 The Queensway, Units 1-4, Peterborough, Ontario, and liquor delivery licence number 52103 issued to 1254667 Ontario Inc., operating as K & T Deliveries (LDS), 671 Cameron Street, Peterborough, Ontario remain in effect until the commencement of the hearing before the Board at which time the Board will consider, on the request of either party, whether to continue one or both interim suspensions;
FURTHER, the Board orders Mr. Ayotte and Mr. Kulis to communicate with each other and the Board promptly following Mr. Ayotte’s return to his office on November 12, 2007 to obtain mutually agreeable dates for the hearing of these matters.
