O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on October 12, 2007 pursuant to Notice of Proposal number 15284 dated May 28, 2007 to suspend a licence issued to Brian Robert La operating as Jenny’s Café & Bar, 65 Kensington Avenue, Toronto, Ontario, M5T 2J9, licence number 804137;
AND WHEREAS the Registrar’s Representative, Phillip Morris, was present and the Representative of record for the licensee, Michael Caroline, did not attend the pre-hearing;
AND WHEREAS these matters are scheduled for a hearing commencing November 29, 2007;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4, ten (10) days before the hearing date.
