O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario ("AGCO") held a pre-hearing teleconference on October 1, 2007 pursuant to Notice of Proposal number 15413 dated July 5, 2007 to suspend a licence issued to 1639857 Ontario Inc., operating as Furbar Nightclub, 140 University Avenue West, Campus Court, Waterloo, Ontario, N2L 6J3, licence number 802685;
AND WHEREAS the Registrar's Representative, Ed Wren, the Licensee's Representative, David McCarthy, and Charles Smith, a principal of the corporate licensee, were present on the conference call and participated in the pre-hearing;
AND WHEREAS these matters are scheduled for a hearing commencing December 4, 2007;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar's Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness' evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar's Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
