O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on October 24, 2007 pursuant to Notice of Proposal number 15445 dated July 11, 2007 to suspend a licence issued to 1089892 Ontario Inc., operating as Roxy’s Nightclub, 1075 Memorial Avenue, Thunder Bay, Ontario, P7B 4A4, licence number 803562;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Lee Baig, were both present on the conference call and participated in the pre-hearing;
AND WHEREAS these matters are scheduled for a hearing commencing November 6, 2007;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made no later than October 29, 2007;
The Registrar’s Representative will complete any further disclosure, including that relating to any issues arising from an incident alleged to have occurred on or about October 16, 2007 if the Registrar seeks to have any such allegations addressed at the hearing, no later than October 26, 2007.
