O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing teleconference on September 11, 2007 pursuant to Notice of Proposal number 15434 dated July 11, 2007, to suspend a licence issued to 2068703 Ontario Inc., operating as Modean’s Roadhouse, 130 Argyle Avenue North, Listowel, Ontario, N4W 1M8, licence number 92290;
AND WHEREAS the Registrar’s Representative, Phillip Morris, and the Licensee’s Representative, Frances Brennan, were both present on the conference call and participated in the pre-hearing;
AND WHEREAS these matters will be heard at a hearing as yet to be scheduled;
THEREFORE the Board hereby ORDERS as follows:
The Licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, and specifically incident report logs for the dates in issue in the Notice of Proposal, such disclosure to be made fourteen (14) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., fourteen (14) days before the hearing date.
