A hearing into a Notice of Proposal number 15319 dated June 4, 2007 to suspend the licence and add a condition to liquor licence number 200394 issued to Kevin Charles Perrin operating as THE BOAR’S NEST, 229 Lewis Street, Cardinal, Ontario, K0E 1E0, on the basis of alleged violations of section 29 of Ontario Revised Regulation 719/90 (O.Reg) made pursuant to the LLA was held on August 22, 2007 in the City of Toronto.
Richard Kulis, Registrar’s Representative, and Douglas Grenkie, Licensee’s Representative submitted an Agreed Statement of Facts (Exhibit #1) and Joint Submission on Disposition (Exhibit #2) which form part of this decision. It was agreed and admitted that:
On February 1, 2007, at approximately 3:40 a.m., two beer bottles had not yet been cleared from the licensed premises.
- Based on the Agreed Statement of Facts, the Board found the Licensee breached section 29 of O.Reg.
Order
- Therefore, having considered the Joint Submission on Disposition, the Board confirms its oral order that the liquor licence issued to Kevin Charles Perrin operating as THE BOAR’S NEST, 229 Lewis Street, Cardinal, Ontario, K0E 1E0, licence number 200394, be suspended for SEVEN (7) consecutive days to COMMENCE at 11:00 a.m. on September 4, 2007 and CONTINUE until 2:00 a.m. on September 11, 2007.

AGREED STATEMENT OF FACTS
The Licence Holders, through their Legal Counsel, and Registrar’s Counsel agree to the following facts in relation to the Notice of Proposal to Suspend a Licence and to Add a Condition the Licence dated Jun 4, 2007:
On February 1, 2007, at approximately 3:40 a.m., two beer bottles had not yet been cleared from the licensed premises.
Based upon the above-admitted facts, the licence holders admit to a violation of section 29 of Revised Regulation 719/90 under the Liquor Licence Act.
JOINT SUBMISSION ON DISPOSITION
Whereas the licensee served a 24 day suspension in January 2006;
The Licence Holders, through their Legal Counsel, and Registrar’s Counsel jointly submit that the following disposition is appropriate in these circumstances:
- A seven (7) day suspension of liquor licence number 200394 to be served consecutively from September 4, 2007 at 11 a.m., until September 11, 2007 at 2 a.m.
