AND IN THE MATTER OF THE LIQUOR LICENCE OF PENTHOUSE RESTAURANT AND TAVERN INC. OPERATING AS
PENTHOUSE RESTAURANT AND TAVERN, 1628 JANE STREET, TORONTO, LICENCE NO. 20063
O R D E R
WHEREAS the Board of the Alcohol and Gaming Commission of Ontario (“AGCO”) held a pre-hearing conference on June 11, 2007 pursuant to a Notice of Proposal dated March 14, 2007 and a Supplementary Notice of Proposal dated May 10, 2007 to suspend a licence issued to Penthouse Restaurant and Tavern Inc. operating as Penthouse Restaurant and Tavern, 1628 Jane Street, Toronto, M9N 2R9, licence number 20063;
AND WHEREAS the Registrar’s Representative, Bryna Kaplan, and the Corporate Licensee’s Representative, Louis Rajnauth, were both present and participated in the pre-hearing;
AND WHEREAS these matters are scheduled for a hearing commencing June 28, 2007;
THEREFORE the Board hereby ORDERS as follows:
The corporate licensee, through its Representative, shall disclose to the Registrar’s Representative pursuant to Rule 7 of AGCO Rules of Practice and specifically pursuant to Rule 7.3, a list of its witnesses and a summary of each witness’ evidence, as well as disclosure pursuant to Rule 7.4, such disclosure to be made ten (10) days before the hearing date;
The Registrar’s Representative will complete any further disclosure, also pursuant to Rule 7.4., ten (10) days before the hearing date.
Having been advised by the parties that a further Notice of Proposal, #15247, has been issued and that a Request for Hearing will be filed, on consent of the parties, Notice of Proposal #15247 will be scheduled to be heard with the Notice of Proposal dated March 14, 2007 and the Supplementary Notice of Proposal dated May 10, 2007, on June 28, 2007.
